Terms of Use

These Terms of Use ("Terms") govern your access to and use of the BlueMesa Exchange website at bluemesa.co.com and all associated platform services operated by DIRE MONEY TRANSMITTER LLC ("Company," "we," "us"). By accessing the website or opening an account, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Eligibility and Account Requirements

1.1 You must be at least 18 years of age and a legal resident of a US state in which the Company is authorized to provide services.

1.2 You must successfully complete identity verification through our AML/KYC process before accessing trading or wallet services. Identity verification requires submission of accurate, complete, and current documentation.

1.3 You may not open an account on behalf of another individual without proper authorization. Business accounts require documentation of entity authority and beneficial ownership.

1.4 We reserve the right to refuse account registration or terminate existing accounts at our discretion, including for failure to complete verification, providing false information, or violation of these Terms or applicable law.

2. Platform Services

2.1 BlueMesa Exchange provides a digital asset exchange platform enabling the purchase, sale, and transfer of supported digital assets, and a software wallet for custody of those assets within the platform.

2.2 Services are subject to availability. We do not guarantee uninterrupted access to the platform. Scheduled and unscheduled maintenance may temporarily limit service availability.

2.3 The list of supported digital assets may change. We may add or remove assets from the platform at any time. No digital asset listed on the platform is endorsed or recommended by us.

2.4 All transactions are subject to compliance review. We may delay, suspend, or decline transactions where required by our AML program, applicable law, or risk management procedures.

3. Fees

3.1 Fees applicable to your account and transactions are disclosed on the Fee Schedule page at fees.html and at the time of transaction confirmation.

3.2 We reserve the right to modify fees. Fee changes will be communicated with advance notice as required by applicable law. Continued use of the platform after fee changes constitutes acceptance of the updated schedule.

3.3 Network fees for on-chain transactions are determined by blockchain network conditions and are not set by BlueMesa Exchange. These fees are passed through to users.

4. Prohibited Conduct

4.1 You may not use the platform for any purpose that violates applicable federal, state, or local law, including anti-money laundering laws, sanctions regulations, or securities laws.

4.2 You may not attempt to circumvent our compliance procedures or provide false or misleading information during the verification process or at any time during your use of the platform.

4.3 You may not use automated tools, bots, or scripts to access the platform in ways not authorized by us.

4.4 You may not engage in market manipulation, wash trading, or any activity designed to create artificial trading volume or price movements.

5. Regulatory Compliance Obligations

5.1 As a FinCEN-registered Money Services Business, we are required to maintain transaction monitoring programs and file reports including Currency Transaction Reports (CTRs) and Suspicious Activity Reports (SARs) as required by the Bank Secrecy Act.

5.2 We comply with OFAC sanctions screening requirements. Accounts associated with sanctioned individuals, entities, or jurisdictions will be blocked and may be reported to the appropriate authorities.

5.3 You acknowledge that your use of the platform is subject to monitoring as required by federal law and these Terms.

6. Risk Disclosure

6.1 Cryptocurrency and digital assets involve substantial risk of loss. You may lose all of the value you place into digital assets. Past performance of any digital asset is not indicative of future results.

6.2 Digital assets held through BlueMesa Exchange are not FDIC insured, not bank guaranteed, and not backed by any government or government agency.

6.3 Nothing on this platform or in any communication from BlueMesa Exchange constitutes investment advice, financial advice, legal advice, or tax advice. You are solely responsible for your own investment decisions.

7. Error Resolution

7.1 If you believe an error occurred in your account, you must notify us in writing within sixty (60) days of the date the error appears on your account statement. Include your account information, the date and amount of the error, and a description of the error.

7.2 We will investigate and respond within the timeframes required by applicable law. If an error is confirmed, we will correct it. If we determine no error occurred, we will provide a written explanation.

7.3 For errors involving electronic fund transfers, additional rights may apply under the Electronic Fund Transfer Act (EFTA) and Regulation E where applicable.

8. Limitation of Liability

8.1 To the maximum extent permitted by applicable law, DIRE MONEY TRANSMITTER LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including losses resulting from digital asset price changes, platform outages, or security incidents beyond our reasonable control.

8.2 Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the fees you paid to us in the three months preceding the claim.

9. Intellectual Property

9.1 All content on the BlueMesa Exchange website, including text, graphics, logos, and software, is the property of DIRE MONEY TRANSMITTER LLC or its licensors and is protected by applicable intellectual property laws.

9.2 You may not reproduce, distribute, modify, or create derivative works from platform content without express written permission.

10. Termination

10.1 You may close your account at any time by contacting us. You must withdraw any remaining balances before account closure. We will process closure requests subject to any pending compliance holds or legal requirements.

10.2 We may suspend or terminate your account for violation of these Terms, failure to maintain compliance with our AML/KYC requirements, or as required by law.

11. Governing Law and Dispute Resolution

11.1 These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles, except where federal law applies.

11.2 Any dispute arising from these Terms or your use of the platform shall first be submitted to informal resolution by contacting us in writing. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in St. Louis, Missouri, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

11.3 You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Modifications

12.1 We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Where required by applicable law, advance notice will be provided. Continued use of the platform after changes constitutes acceptance of the updated Terms.
